On 18 December 2016,
Professor Zhou Dawei, Distinguished Fellow at the Legal Research Institute at
the Chinese Academy of Social Sciences (CASS) gave a lecture at the Centre for
Common Law on the judicial system in the US in the context of small claims
cases.
Having studied at the
University of Illinois Law School and been a visiting scholar at both Columbia
and Stanford Universities, Prof Zhou was able to draw on his considerable experience
to provide an insight into the US legal and judicial systems. Using a recording
of an infringement trial Prof Zhou anaysed the procedures used in the US, as
well as the role of mediation in small claims cases.
Prof Zhou also
discussed the provisions relating to small claims cases in China’s revised
Civil Procedure Law, saying that while the practices are still relatively new in
China, the provisions made regulations much clearer for the lower level courts.
